Complaints, Fitness to Practise and Professional Support

Cover that pays patient compensation is not the same as cover that provides advice or representation for a dental nurse facing complaints, employment investigations, GDC fitness to practise enquiries, coroner or procurator fiscal investigations, police requests, disciplinary hearings, or requests for personal professional advice.

An employer's policy can protect patients and the employer from negligence claims but may not guarantee independent guidance for a nurse whose conduct, communication, record keeping or clinical judgement is questioned. Some dental nurses hold personal membership or additional indemnity to ensure they have access to advice and representation even when employer cover meets the GDC patient compensation requirement.

A patient complaint names the dental nurse and alleges the nurse gave misleading aftercare information. The practice says its policy covers negligence claims but it is unclear whether the policy offers advice to the nurse personally.

What should the nurse consider?

 

Employer cover may satisfy the patient compensation requirement, but it may not give the dental nurse independent advice or representation in every professional situation.
